can't upload photo to public folder

I noticed that user can't upload their pictures in the public folders if their own quota is almost full. I think quota checking should not be checked when user want to upload their pictures to the public area. Is it a bug for the case? How to solve it?

It's a disk quota per user so it does what it says. I only use the public albums for users to upload pictures. So I use this to prevent flooding by single users.
